The Last Will and Testament of Harmon Shell

In the name of God Amen I Herman Shell* of Coweta County, Georgia being of Sound and disposing mind and memory and calling to mind the uncertainty of life and being desirous to despose of all such worldly estate as it has pleased God to bless me with, do make and ordain this my last will in manner following that is to say

First I desire that my wife keep all my property all her natural life but what is hers in after desposed of or as much of it as She wishes except what may be sold by concent of her and my Executors to pay my just debts.

2ndly that my son James E. Shell in his lifetime had property money and notes that I gave and paid for him to the amount of twelve hundred and seventy three dollars and fifty one cents reference being had to a memorandum bearing date of 18 day of January 1826 my will is that none of his heirs receive any of my property or money arising there from untill my under named children receive the amount above named that he has received.

3rdly My Son Thomas E. Shell has had one horse and money and notes that I gave and paid for him to the amount of one thousand and one dollars and ninety nine and a half cents according to the above mentioned memorandum my will is that Thomas H. (sic) Shell receive none of my property or money, arising there from untill my under named children receive the above named amount that he has received.

4thly My daughter Nancy L. Sibley has had property to the amount of Four hundred and twenty dollars and I will that She has the use of a negro woman named Betty during her natural life at the value of two hundred dollars more and that the said negro or any other that my Executors may procure by exchange or other wise in her sted which shall at the decease of said N L Sibley go to her heirs and that She receive no part of my property or the moneys there from till the other children with a less sum receive to said amount.

5thly My Son Wm B. Shell has received property to the amount of three hundred and ninety dollars and I further will that my land at the death of my wife be his at the price of three hundred dollars and thus he receive no more of my property or the procedes there of till the children of less sum receive same amount.

6thly My Son Daniel A. Shell has received money in the amount of four hundred dollars and my will is that at the first sale which shall be after my death for money to pay my just debts that the (sic) receive there of go to those that have received a small portion in equalising their portions and at the Sale which Shall be at my wife's death in the same manner till their portions are all equal or as near so as can be and lastly I do constitute and appoint my Son William B. Shell and my friend Richard Levael Executors of this my last wil and Testament by me hertofore made in testimony where of I have here unto set my hand and seal this eighth day of April one thousand eight hundred and thirty four.

Hatton you and each of you do solemly swear that you saw Herman Shell sign seal publish and declare this writing to be and contain his last will and testament and that at the time there of he was of sound disposing mind and memory and that he did it freely and without confusion to th best of your knowledge so help you God and also that you saw each other sign and witness Sworn and disclosed in open Court this third day of Nov 1834
